    Stephen:I’m calling with regards to a problem that I’m having with regards to a birth certificate. I had recently gotten a new birth certificate, and I failed to really look at it in detail. I went to the DMV to try to get my license renewed, and my name was wrong. I went to the state of New York to explain the situation to them, and not only is my name wrong, but both of my parents’ names are wrong. Now, I went back and forth for almost a year with the state trying to get this corrected. My parents have been divorced over 30 years. They wanted marriage certificates and even complicated even more, because my father, when he came over, he had the old world writing where basically he also has his mother’s name at the end of his birth certificate.
    Attorney Tom Olsen:Stephen, let’s stop for a minute. The fact that your parents’ names are wrong on there, at the end of the day, it’s not going to make any difference. The real issue is that your name is wrong or, at least, it’s different than what you’re using out there in the public. Stephen, did they just spell the name Stephen differently, or how off are they on the birth certificate?
    Stephen: They’re off on the last name, and they won’t change it. This is the reason I was talking about my parents, because my father’s last name has two names there. Now, they’re trying to say that my last name shouldn’t even be my last name, it should be as it’s done under my father’s name.
    Attorney Tom Olsen:Stephen, if we looked at your driver’s license, social security, bank accounts, deeds, everything is in one name that’s the same name, but everything is different than what your birth certificate actually says?
    Stephen:Correct.
    Tom Olsen:Stephen, what you’re going to have to do is you’re going to have to do a legal name change, which is no big deal. Once you get a legal name change done, you’re going to get a court order that says, from now on, this is your legal name, Stephen. Then, you present that to the Vital Statistics Office in New York, and they will literally do a new birth certificate for you.
    Stephen: Okay. Does that come up as an alias or does that flag anything or?
    Attorney Tom Olsen:Oh, I don’t know anything about that but this is not an unusual problem, so I’m saying the way to fix this, Stephen, is to literally get a legal name change. Stephen, you live here in Orlando. This is something that the Circuit court clerks will help you with. In fact, they have a name change package. They will help you fill it out, and help you run through the process, then, you get it done. You get a court order. You get a certified copy of that court order. Send it off to New York Vital Statistics, you get a brand new birth certificate.

Legally, I’m Lenore Hollie, but I go by Holley.
    Attorney Tom Olsen:What you did was, you were doing it one way. You found out that your birth certificate was different, so you just started doing it as your birth certificate, but that, in and of itself, didn’t cause you any real problems as far as banking or deeds, or anything.
    Attorney Holley Knapik:Exactly.
    Attorney Tom Olsen:What about social security card, do you know?
    Attorney Holley Knapik:Social security card reads Lenore Hollie, and so, I stick with that, but my bank account says Hollie, deed Hollie.
